Welcome to Peel App. These Terms of Service ("Terms") govern your access to and use of our platform, services, and website (collectively, the "Services"). By accessing or using Peel App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, logging in via TikTok, or accessing Peel App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

2. Eligibility

You must be at least 18 years old to use Peel App. By using our Services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable local, state, national, and international laws
  • Your use of the Services does not violate any applicable law or regulation

3. Account Registration and Authentication

To access certain features of Peel App, you must create an account. Account creation requires:

  • TikTok Authentication: You may log in using your TikTok account. By doing so, you authorize us to access certain information from your TikTok profile as permitted by TikTok's API and your privacy settings.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Account Verification: We may verify your identity and social media accounts to ensure platform integrity.
  • Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of Meta and TikTok APIs

Peel App integrates with third-party services including Meta (Facebook/Instagram) and TikTok APIs:

  • API Compliance: By using Peel App, you agree to comply with TikTok's Terms of Service, Developer Terms, and Meta's Platform Terms and Developer Policies.
  • Data Access: You grant Peel App permission to access your public profile information, engagement metrics, and other data available through these APIs as necessary to provide our Services.
  • API Limitations: Our Services are subject to the availability and limitations of third-party APIs. We are not responsible for any disruptions caused by changes to or unavailability of these APIs.
  • Revocation: You may revoke API access permissions at any time through your TikTok or Meta account settings. This may limit your ability to use certain features of Peel App.

5. User Content and Conduct

As a user of Peel App, you agree to:

  • Provide accurate and truthful information about yourself and your business
  • Not impersonate others or misrepresent your identity or affiliations
  • Not use the Services for any illegal, harmful, or fraudulent purposes
  • Not attempt to gain unauthorized access to other users' accounts or data
  • Not interfere with or disrupt the Services or servers
  • Respect the intellectual property rights of others
  • Not engage in spam, harassment, or abusive behavior toward other users

6. Creator and Business Relationships

Peel App facilitates connections between creators and businesses:

  • Independent Relationships: Peel App is a platform connecting parties but is not a party to any agreements between creators and businesses.
  • User Responsibility: Users are solely responsible for their interactions, agreements, and transactions with other users.
  • No Guarantee: We do not guarantee the quality, safety, or legality of any user interactions or transactions.
  • Dispute Resolution: Disputes between users must be resolved directly between the parties involved.

7. Intellectual Property

All content, features, and functionality of Peel App, including but not limited to text, graphics, logos, and software, are the property of Peel App and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.

8. Payment and Fees

Certain features of Peel App may require payment:

  • All fees are non-refundable unless otherwise stated
  • You are responsible for all applicable taxes
  • We reserve the right to change our pricing at any time
  • Continued use of paid services after price changes constitutes acceptance of new pricing

9. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PEEL APP DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEEL APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Indemnification

You agree to indemnify, defend, and hold harmless Peel App, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Travis County, Texas.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
